Arbitration

Arbitration is where a third party makes a decision on a dispute to resolve it. We have experience of arbitration, both as an arbitrator and as an advisor in arbitrations. Our Paul Bennett has undertaken arbitrations previously in IT services, in relation to contracts and in the sporting arena.

If you have a partnership or shareholder dispute and you want to appoint Paul Bennett as an arbitrator he will consider the arguments from both sides initially on appointment on paper and then make some directions to ensure that a fair hearing can occur.

At the hearing, which can occur by telephone in urgent situations or Teams or Zoom or in person the arbitrator will then make a decision based upon the evidence presented. Paul Bennett commented:

We will review the papers within a few days and revert to the parties.

The great advantage of arbitration over other forms of ADR and mediation and is that you are certain that an outcome will be achieved, the arbitrator will make a decision and the arbitrator's decision will be legally binding and enforceable and as a consequence if you are considering different forms of ADR you should balance the benefit of certainty and a decision akin to a court achieved quickly, against the mediation benefit of the parties finding their own solution and achieving a win/win.

With the different types of ADR there are naturally distinct advantages and disadvantages. Importantly though arbitration has the advantage of certainty of outcome.
