
Paul Bennett trained as a civil and commercial mediator in 2012 and as a workplace and employment mediator in 2013 and as an evaluative mediator in 2015. We offer the most common form of mediation found in England & Wales, facilitative mediation, and additionally the variant that is more developed and popular in the United States, evaluative mediation.
With a facilitative mediation the mediator works with the parties without expressing a view as a neutral party who helps the parties find their own resolution between matters. Our success rate is over 90%.
With evaluative mediation the process is the same as above but with the added option of both a private comment on the merits of a particular position or indeed the whole case and again with all parties' permission an evaluation can be given in a joint or open session. It is rarely used in the UK but can be useful for things like costs or shareholder and partnership disputes which is where it is emerging as a trend.
If appointed as a mediator we will, unless expressly requested, operate as a facilitative mediator in the traditional England and Wales sense. We will be neutral, and we will not express an opinion.
We can normally convene a mediation online using Zoom and private rooms within days (hours if merited) and we can convene an in person mediation within days ordinarily.
In either case the parties pay the mediation fee upfront ensuring that they are focussed on finding resolution through using mediation and allowing the process to help them find their solution.
