Our Fixed Fee Mediation Service provides the services of Paul Bennett for a fixed fee. This service covers Mediation preparation and up to seven hours Mediation time on a single day.
Eligible cases
- Two party disputes.
- The subject of the Mediation must be a monetary claim with typical disputes including contractual disputes, finance, Partnership or Shareholder disputes including exits or acquisitions.
- Both parties must have agreed a range of dates or a date for the Mediation (we typically ask for 3 to 5 dates to be agreed in advance).
- Both parties must be comfortable utilising the fixed fee service we offer.
- Both parties must pay their relevant contribution to the fee before the Mediation date is confirmed and the date is held in the Mediator's diary.
Ineligible cases
If your dispute is not eligible for our Fixed Fee Mediation Service please contact us for a quote. Cases not eligible for the fixed fee mediation service include:
- Disputes between more than two parties.
- Claims related to property disputes including rights of way or boundary issues, or matters such as clinical negligence or personal injury which are not typically found in Partnership and Shareholder disputes.
- CPR part 8 claims.
- Any dispute which has a non-monetary element as part of the dispute.
- Disputes with a combined claim and counterclaim value in excess of £300,000.
- Disputes outside the jurisdiction of the Courts of England & Wales (although proceedings which would be referred to Arbitration in that jurisdiction are accepted)
Costs
The following are costs per party.

All fees are exclusive of VAT and are price per party.
How to use this service
The following steps are essential to utilise this service:
- Both parties must agree to utilise the Fixed Fee Mediation Service and a minimum of 1 date for the mediation but ideally 3 – 5.
- One or both parties to contact Arbitration and Mediation Services insert email copying in the other party.
- Arbitration and Mediation Services will confirm the availability (or otherwise) of the Mediator.
- The Mediation Agreement and payment of each parties fixed fee shall be paid at least 7 business days prior to the Mediation date (unless it is an emergency Mediation and on shorter notice, in which case both parties shall return the Mediation Agreement and pay the Mediation fee at least one day before the Mediation commences).
- Once payment has been received and the Mediation Agreement has been returned then the Mediators diary shall be held, and the date confirmed.
- Please note that the Mediator's diary will not be held until payment is received from both parties, and if we cannot accommodate date preference we will confirm this and offer alternative dates as soon as is practicable.
